These Referral & Promotional Program Terms ("Program Terms") govern participation in the DrivePhase referral program, influencer/affiliate promotional codes, and any related promotional offers (together, the "Program") operated by DrivePhase LLC, an Indiana single-member limited liability company governed by its managing member ("DrivePhase," "we," "us," or "our").
These Program Terms are an addendum to, and incorporate by reference, the DrivePhase Terms of Service and Privacy Policy. Capitalized terms not defined here have the meaning given in the Terms of Service. The "Service" means the DrivePhase mobile applications, website, and related features. If anything in these Program Terms conflicts with the Terms of Service, these Program Terms control for the Program only.

These Program Terms are an addendum to, and incorporate by reference, the DrivePhase Terms of Service and Privacy Policy. If anything in these Program Terms conflicts with the Terms of Service, these Program Terms control for the Program only.
BY GENERATING, SHARING, REDEEMING, OR APPLYING ANY REFERRAL CODE, INFLUENCER CODE, OR PROMOTIONAL CODE, YOU AGREE TO THESE PROGRAM TERMS.
The Service and the Program are offered only to residents of the United States. The Service is not directed to, or intended for, residents of the European Economic Area (EEA), the United Kingdom, or Switzerland, and such residents should not use the Service or participate in the Program. If we identify that Program data relates to a person in those regions, we will handle it consistent with applicable United States law and will delete it upon request. The Program is administered, and all reward data is processed and stored, in the United States. The Program is void where prohibited or restricted by law.

The Program is a promotional courtesy. It is not part of the paid features of any DrivePhase subscription, and participation does not change the price, billing, or cancellation terms of any Pro subscription you purchase through the app stores.
To participate in the Program, you must:
- Have a DrivePhase account in good standing that complies with the Terms of Service and Community Guidelines;
- Be a resident of the United States; and
- Be at least 18 years of age, OR be 13–17 years of age with parental or guardian consent on file for your account.
Minors and recruitment. Users under 18 may not be incentivized to recruit other users. Accordingly:
- A minor (13–17) may use a referral or promotional code that someone shares with them, and may receive the new-user extended trial described in Section 4, subject to parental/guardian consent for the account.
- A minor may not earn referrer milestone rewards for recruiting other users, and DrivePhase may withhold or void referrer Pro-day rewards that would otherwise accrue to an account belonging to a person under 18.
- We do not direct referral-recruitment incentives, leaderboards, or "earn rewards by inviting friends" prompts to minors, and we do not pay or otherwise compensate minors for recruitment.
DrivePhase employees, contractors, the managing member, and their immediate household members are not eligible to earn referrer milestone rewards through self-dealing or coordinated redemptions.
When a new user redeems your referral code during sign-up and qualifies (see Section 5), the reward structure currently works as follows.
4.1 Reward to the new user (the redeemer)
A new user who redeems a valid referral code receives an extended free trial of DrivePhase Pro — currently the standard introductory trial extended by two (2) additional days. This extended trial is applied as app-controlled trial time and does not require a separate purchase. The redeemer may redeem one (1) referral or influencer code, one time, ever per person (see Sections 6 and 7).
4.2 Reward to the referrer (Pro-day milestones)
As your qualifying referrals accumulate, you earn one-time grants of DrivePhase Pro days at the following milestones. Milestones are cumulative and each is granted once:

Earned Pro days extend your DrivePhase Pro access. If you are already a paying Pro subscriber, earned Pro days are added after the end of your current paid period so that promotional days are not consumed while you are already covered by a paid subscription. Earned Pro days are promotional access only; they do not create, renew, or auto-renew any paid subscription, and they confer no cash value.
4.3 We may change the reward tiers
The specific reward amounts, milestone thresholds, trial-extension length, discount percentages, eligible offerings, and qualification rules described in these Program Terms are current as of the Effective Date and may change at any time in our sole discretion. We may add, modify, reduce, pause, or remove reward tiers prospectively. Changes do not retroactively revoke rewards already validly granted, but they may affect rewards not yet earned.
A referral does not count immediately. To protect against abuse, a redeemed referral becomes a qualifying referral only after all of the following are true:
- A waiting period of at least forty-eight (48) hours has elapsed since redemption;
- The referred user has completed account onboarding; and
- The referred user's account still exists (an account that is deleted before qualifying does not count).
Referrals that are pending, never complete onboarding, are later deleted, or are flagged as fraudulent or abusive do not count toward your milestones, and any associated rewards may be withheld or reversed.
- The maximum referrer reward is the 100-referral milestone tier described in Section 4.2. There are no milestone rewards beyond that tier under the current structure.
- Each person may redeem one (1) code, one time, ever (referral or influencer). Existing accounts that were not created through a code redemption are not eligible for the new-user extended trial.
- All rewards are promotional, non-transferable, and have no cash value. Rewards may not be sold, bartered, combined except as we expressly allow, or exchanged for money, credit, or any other consideration. Unused promotional Pro time expires when the underlying access period ends and is not refundable.
- Rewards are per-account and tied to the account that earned them. Rewards do not survive account deletion.
The Program is intended for genuine, person-to-person referrals and approved promotions. The following are prohibited, and we enforce them through automated and manual controls:
- One redemption per person. Each person may redeem only one code, ever. You may not redeem your own referral code, and you may not create or use multiple or duplicate accounts (including via deleting and re-creating an account, or using alias/disposable email addresses) to redeem additional codes or inflate referral counts.
- No self-referral or circular referral. You may not redeem a code in a way that rewards yourself, and you may not coordinate with others to redeem each other's codes for the purpose of farming rewards.
- Rate limits. Redemptions per code are rate-limited over rolling time windows. Codes that exceed normal, organic redemption volume may be throttled, paused, or voided.
- No spam, scraping, bots, or mass distribution. You may not post codes to coupon farms, bot networks, or incentivized-traffic schemes, or distribute codes through spam, automated tools, scrapers, or any deceptive or unsolicited means.
- No fake or non-genuine accounts. Referrals from throwaway, automated, or non-genuine accounts, or accounts that never complete onboarding, will not qualify and may be reversed.
- Audit and verification. We log and audit redemption attempts and outcomes to detect enumeration, brute-force, and abuse patterns. We may verify the legitimacy of any referral and may withhold rewards pending verification.
We may detect duplicate or re-created accounts using privacy-protective signals (for example, an irreversible one-way hash of the account email), consistent with our Privacy Policy. We do not sell this data, and we use it only for fraud prevention and Program integrity.
We reserve the right, at any time and in our sole discretion, without prior notice, to:
- Modify, suspend, pause, or discontinue the Program, any code, any reward tier, or any promotion, in whole or in part, prospectively;
- Void, withhold, reverse, or claw back any reward, milestone credit, extended trial, or discount that we reasonably believe was obtained through fraud, abuse, error, duplicate accounts, automated activity, or any violation of these Program Terms, the Terms of Service, or the Community Guidelines;
- Disqualify, suspend, or remove any participant, code, or account that violates these Program Terms;
- Correct administrative, technical, pricing, or system errors, including reversing rewards granted in error; and
- Terminate the Program entirely.
If we determine that a reward was issued in error or as a result of prohibited activity, we may remove the corresponding Pro access and adjust your account accordingly. Termination or modification of the Program does not entitle any participant to compensation.
Influencer and affiliate codes are issued only to promoters we approve. When a new user applies a valid, active influencer code, the user is shown a discounted DrivePhase Pro price on the in-app purchase screen. All purchases are processed by the Apple App Store or Google Play; the discounted price, billing, renewal, and cancellation are handled through the applicable app store, and DrivePhase never receives or stores your payment card details.
Influencer codes:
- May have expiration dates, redemption caps, and active/inactive status, which we may set, change, or revoke at any time;
- Apply a discount to a subscription purchase (they are not free Pro days), and are subject to app-store terms; and
- Are subject to the same one-code-per-person and anti-abuse rules in Sections 6 and 7.
9.1 Required FTC disclosure by promoters
If you promote DrivePhase using an influencer, affiliate, or partner code — or otherwise receive any compensation, commission, free or discounted access, or other benefit in connection with promoting DrivePhase — you are solely responsible for clearly and conspicuously disclosing that material connection in compliance with the U.S. Federal Trade Commission's Guides Concerning the Use of Endorsements and Testimonials in Advertising, 16 C.F.R. Part 255, and all other applicable advertising, endorsement, and consumer-protection laws.
Disclosures must be clear, conspicuous, unavoidable, placed near the endorsement, and understandable to the average consumer (for example, plainly stating "#ad," "paid partnership," or "DrivePhase partner" rather than relying on vague or buried tags). Promoters must not make false, misleading, or unsubstantiated claims about the Service, its results, or its analysis features, and must not present DrivePhase analysis as medical, dietary, or professional advice. Promoters who direct their promotion to or knowingly reach audiences that are predominantly minors must take additional care to comply with the FTC's endorsement Guides and laws protecting minors. DrivePhase is not responsible for a promoter's failure to comply, and we may revoke any code and terminate any promotional relationship for non-compliance.
Any tax consequences arising from rewards are the sole responsibility of the recipient. Because rewards are promotional Pro access with no cash value, we do not expect them to be taxable; however, we make no representation, and you should consult your own tax advisor.
Data we process to operate the Program (such as your referral code, redemption records, qualification status, milestone rewards, applied influencer codes, and fraud-prevention signals like an irreversible email hash) is handled in accordance with the DrivePhase Privacy Policy. We do not sell referral or Program data. Program data is processed and stored in the United States and is retained and deleted in accordance with the retention schedule in the Privacy Policy, including on account deletion.
The Program is administered solely by DrivePhase. It is not sponsored, endorsed, administered by, or associated with Apple Inc. or Google LLC. App-store purchases (including discounted Pro purchases via influencer codes) are governed by the applicable app store's terms.
The Program is provided "as is" and "as available," without warranties of any kind. To the maximum extent permitted by law, DrivePhase disclaims all warranties relating to the Program and is not liable for any failure to issue, calculate, or deliver a reward, or for any code, technical, or system error. The limitations of liability and disclaimers in the Terms of Service apply to the Program. Nothing in these Program Terms limits any non-waivable rights you may have under applicable U.S. state law.
These Program Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to the Program is subject to the dispute resolution, binding arbitration (AAA Consumer Arbitration), class-action waiver, 30-day opt-out, and venue (Marion County, Indiana) provisions set out in the DrivePhase Terms of Service, which are incorporated here by reference. The Program is void where prohibited.
We may update these Program Terms from time to time. The "Last Updated" date above reflects the most recent revision. Material changes will be reflected by an updated version number and date. Your continued participation in the Program after changes take effect constitutes acceptance of the revised Program Terms.
